Bolton Didn’t Win, Trump Didn’t Lose

Much ado has been made about the Justice Department’s failure to stop John Bolton’s upcoming “tell all” book from being published. Friday, federal Judge Royce Lamberth, a Reagan appointee, refused to grant an injunction against Bolton’s book, thereby allowing publication to proceed. The decision seemed to be a body blow against a Justice Department that had sought to block the release of Bolton’s book arguing that he used classified material to write it.

Leftists and John Bolton, of course, were quick to declare victory against the evil President Orange Man Bad. President Trump, however, was quick to declare victory after Judge Lamberth issued his decision.

Democrats everywhere pointed out that Orange Man Bad had, in fact, lost bigly. YOU LOST was trending on Twitter in big, bold letters soon after President Trump made his announcement. Concerned conservatives also pointed out that it sure did seem like Team Trump aimed for a home run and ended up whiffing badly.

That’s not really the case, however.

When you look beyond the spin and read what Judge Lamberth actually wrote, it’s pretty clear that the judge refused to grant the injunction against Bolton’s book because it had already passed the point of no return. In fact, Judge Lamberth had previously warned the DOJ that there probably wasn’t a whole lot that he could do in this case.

A federal judge on Friday heard arguments on a request by the Justice Department to block the publication of former national security adviser John Bolton’s memoir over concerns it contains classified information — but the judge warned “the horse … seems to be out of the barn,” as copies have already been distributed.

“It certainly looks difficult to me over what I can do about all these books all over the country,” Judge Royce Lamberth said.

In other words, there were so many copies of the book already printed, and so much had been leaked to the press already, that an injunction would be pointless. No fake news resister worthy of the title would throw out their advance copy of Bolton’s book just because a judge ordered them to. They’d sit on it and leak it out drip by drip all while trying to score a television movie based on their harrowing tale of Resistance against Trump’s Stasi attempting to silence the truth.

Judge Lamberth’s statement makes it abundantly clear that his ruling doesn’t let Bolton off the hook, either. Lamberth outright states that Bolton has exposed himself in a huge way.

“Defendant Bolton has gambled with the national security of the United States. He has exposed his country to harm and himself to civil (and potentially criminal) liability,” Judge Royce Lamberth said in a ruling.  “But these facts do not control the motion before the Court. The government has failed to establish that an injunction will prevent irreparable harm.”

Essentially, Lamberth straight up says that Bolton screwed up in a big way, likely used classified material, and has opened the door to civil and criminal prosecution. The DOJ, in fact, is currently mulling whether to charge Bolton criminally over his book.

In the end, though, the question boils down to who won in this case-Bolton or Trump? I would argue that Bolton did not win. Judge Lamberth did not mince words in his decision, and it’s very clear that the only reason he’s not issuing the injunction is because it wouldn’t work in this case. Lamberth’s ruling is written in such a way that Bolton will be unable to use it as a defense. I wouldn’t be surprised to see Bolton and the media stop talking about this altogether because of that.

Bolton won the battle because the injunction was not issued. He lost the war, however, because Lamberth’s ruling can (and probably will) be used against Bolton in any court proceedings. It’s going to be a devastating attack against him, quite frankly.

Trump lost the battle in that he failed to stop the publication of a book filled with lies built upon classified information. The DOJ swung into action too late to accomplish much in this regard. However, Trump won the war because he gained a very potent weapon to use against Bolton in the future. President Trump’s tweets make it abundantly clear that he intends to use Lamberth’s ruling to teach Bolton and other deep state cretins a lesson.

President Trump, in my estimation, is the one who comes out ahead in this little scrap. I think future events will prove me correct.
