Yes, it’s clever BUT it’s also very, very, VERY close to stepping over the line from political banter to starting down the road of no return. And what does that road look like? It’s declaring that a coup is in progress and charging individuals under 18 U.S. Code § 2385 — Advocating overthrow of Government.
Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government; or
Whoever, with intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so; or
Whoever organizes or helps or attempts to organize any society, group, or assembly of persons who teach, advocate, or encourage the overthrow or destruction of any such government by force or violence; or becomes or is a member of, or affiliates with, any such society, group, or assembly of persons, knowing the purposes thereof—
Shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
As you no doubt know, President Trump tweeted on Sunday:
His lies were made in perhaps the most blatant and sinister manner ever seen in the great Chamber. He wrote down and read terrible things, then said it was from the mouth of the President of the United States. I want Schiff questioned at the highest level for Fraud & Treason…..

Can Schiff currently be charged with treason? Let’s all read the Constitution together:
Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.
The answer, therefore, is “no.”
Can he be questioned for fraud? I suppose but I’m not sure what that actually means.
One way we could parse “I want Schiff questioned at the highest level for Fraud & Treason…..” is that it’s just Trump being Trump with kind of a “I double dare you.”
On the other hand, we seem to be creeping day by day to “the following individuals are hereby charged with violation of 18 U.S. Code § 2385 also known as the Smith Act.” The last time anyone was convicted under the act was in 1949 when eleven leaders of the Communist Party were convicted.
We’ve somewhat cavalierly used the term “coup” as a power word to describe the Democrat “Resistance.” What if President Trump not only declares a coup to be in progress but announces steps to protect the presidency from the coup?
We seem to be within a whisker of CIA and FBI agents being rounded up and charged with violation of the Smith Act. These are incredibly powerful Agencies. Will they sit placidly by and watch their leaders being charged with sedition? Not very likely. What will they do? I have no idea but they have guns and know how to use them.
How close are we to actually charging some Democrats under the Smith Act? I think a ways but this shit could get out of control really quickly. And you know what? If it does, it’s all on the Democrats although it’s everyone in the country who will pay the price of the damage to the country.
