Red Flag Laws are Dumb

Red flag laws are dumb — because

they’re being conceived by people who are not law enforcement.

The same people that are saying we need Red Flag laws are the same ones who are saying “finding a potential mass murderer is like finding a needle in a haystack.”

Let’s take a step back here. If the FBI Director said “we are lacking the proper set of tools to identify, track, determine probable cause, and arrest domestic terrorists (or foreign terrorists for the matter), I’d say “let’s discuss the tools you need.”

It’s up to the FBI to tell us what they need and not for a bunch of people in Congress to guess!

The guessing really pisses me off and I suspect it does so with professional law enforcement as well.

Has anyone heard the FBI asking for Red Flag laws? Maybe they have and I don’t know about it. If they had such laws, I can’t imagine how it helps much since the issue isn’t getting them into custody, it’s that we don’t know potential perpetrators are potential perpetrators until they perpetrate!

We do have some evidence that the FBI is doing a pretty good job on ISIS terrorists and (although I know some of you don’t like the term) “white supremacists.” At the very least FBI Director Christopher Wray said recently that the FBI had arrested about a 100 of them.

The things I’m really interested are —

  • Does the FBI have the tools it needs to identify people who are communicating on the Internet in ways that fit the profile of an individual likely to commit a mass murder? I discussed what these markers are in The Mind of a Mass Murderer.
  • If the FBI has identified someone for which they have probable cause to commit a mass murder, do they have the legal tools to apprehend that individual?
