What can you Expect in the run-up to the Confirmation Vote for Brett Kavanaugh

Judge and President Donald Trump’s Supreme Court nominee Brett Kavanaugh has finally cleared the Senate Judiciary Committee circus and has proceeded to the Senate floor for consideration. This was the moment that it happened:

A very cool scene, except that now Jeff Flake of Arizona and his two deputies Lisa Murkowski of Alaska and Susan Collins of Maine are requesting that the —ostensibly— Democrat-led FBI conduct another investigation into Kavanaugh before they will vote to confirm Brett Kavanaugh.

One critical thing that did happen though, Mitch McConnell did in fact open debate on the nomination.

“So, this is a nomination that deserves to move forward — and that is precisely what is happening. I commend our colleagues on the Committee for sending this impressive nominee here to the floor with a favorable recommendation. Now we will keep the process moving: The full Senate will begin considering Judge Kavanaugh’s nomination today,” said Sen. Majority Leader Mitch McConnell, R-Kentucky.

In order to end debate, the nominee needs 72 hours of floor time, then they can call to end debate with the cloture vote. Until McConnell and the Republicans abolished the filibuster for the Supreme Court (which happened after Harry Reid did the same action for the lower courts and cabinet-level nominees), the Senate would need to have 60 votes to move forward or be stuck in debate forever.

Now after the time limit is up, McConnell will be able to call a cloture vote and will only need 50 votes plus Vice President Pence. Clarence Thomas’ FBI background check took three days, it wouldn’t be too far of a stretch to expect a similar timeline for Brett Kavanaugh’s own background check, given that he’s already had six of them so far.

After confirmation, Brett Kavanaugh could recuse himself from all cases that he didn’t hear the oral arguments from, but that is not required under the rules or the law. The Supreme Court also isn’t hearing many exciting cases at the beginning of the session either, so a minor delay is not going to affect much.
