SCOTUS Justice Kennedy just stayed last weeks 9th Circus ruling on the Trump Travel Ban which would require the government to allow refugees covered by resettlement agreements to enter the United States.
The DOJ did not ask for a review of the “relationship” issue, only that covering resettlement agreements.
The is a “partial” schlonge to the face of the 9th. It means that SCOTUS will have at least a 5-4 ruling on this part of the ban. The relationship part remains up in the air.
(Hawaii can still file to argue to lift the stay tomorrow, but this should be an uphill battle.)
