The Trump Administration and Department of Justice just filed an Emergency Appeal of the Seattle Federal Judge with the 9th Circuit Court of Appeals.
The Justice Department on Saturday appealed a decision by the Ninth Circuit Court of Appeals that stopped enforcement of the executive order banning travel to the US from seven Muslim-majority countries and suspending refugee entry to the US.
Notice that CNN erred saying the decision was BY the 9th Circuit.
Fox News is reporting same. And from the Seattle Times:
The Trump administration on Saturday afternoon appealed federal Judge James Robart’s travel-ban ruling to the U.S. Court of Appeals for the 9th Circuit, in San Francisco.
The one paragraph filing contains no arguments, but is simply a notice of appeal.
It is filed on behalf of “the defendants Donald Trump, in his official capacity as president of the United States; United States Department of Homeland Security; John F. Kelly in his official capacity as Secretary of the Department of Homeland Security; Rex W. Tillerson in his official capacity as Secretary of State and the United States of America.”
The 9th Circuit will be expected to rule against the Trump Administration. If so, it will head to SCOTUS.
